Commercial framework
Professional equipment hire terms.
A plain-English framework for equipment care, payment, safe use, return and accountability. Project-specific details are confirmed in the written quotation and equipment schedule.
1. Contract documents and parties
The supplier is the legal entity identified in the written quotation. The hirer is the person or organisation accepting it. The contract comprises the accepted quotation, equipment schedule, these terms and any model-specific instructions. If documents conflict, the quotation and equipment schedule take priority for project-specific details.
2. Suitability and information supplied
The hirer must provide accurate information about the application, location, volume, materials, operating window and intended operator. A recommendation is based on that information. The supplier may decline, amend or suspend the hire if the proposed use is unsafe, unlawful, materially different or outside the equipment's intended scope.
3. Hire period and availability
The hire period, commencement, minimum term and expected return date are stated in the quotation. Availability is not reserved until the supplier confirms the order. Extensions require written agreement and remain subject to availability and additional charges.
4. Charges, deposit and payment
Hire charges, delivery or collection costs, deposit requirements, taxes and payment dates are stated in the quotation. Unless agreed otherwise, charges continue until all equipment is returned and accepted. Late payment, failed collection, excessive cleaning, missing items and repair beyond fair wear may be charged at the rates or reasonable costs identified in the contract.
5. Delivery, collection and acceptance
The hirer must provide safe and suitable access and an authorised person to receive or release the equipment. Dates and times are estimates unless expressly guaranteed in writing. The hirer must inspect the package promptly and report visible damage, shortage or incorrect items before use.
6. Permitted use and operator responsibility
Equipment may be used only for the agreed professional application, by competent authorised operators, at the stated site and in accordance with instructions, training, risk assessment and law. It must not be modified, opened, sub-hired, moved to another site or used in an occupied treatment area contrary to the approved procedure without written consent.
7. Ozone safety and site controls
The hirer is responsible for COSHH assessment, exclusion of people, animals and plants where required, warning signage, access control, leakage prevention, ventilation, suitable monitoring and verified re-entry. Ozone is hazardous to health. Elapsed time or odour alone must not be treated as proof that a space is safe to re-enter.
8. Care, inspection and maintenance
The hirer must keep equipment secure, dry, clean and protected from misuse, contamination, impact and unsuitable power supplies. Required pre-use checks must be completed. Faults must be reported immediately; use must stop where continued operation could be unsafe or worsen damage. Only the supplier or an authorised service provider may repair the equipment.
9. Risk, title, loss and damage
Ownership remains with the supplier. Risk passes as stated in the quotation, normally on delivery or collection, and continues until the supplier accepts the returned equipment. The hirer must take reasonable security precautions and notify the supplier promptly of theft, loss, damage, seizure or an incident involving the equipment.
10. Insurance
Where required by the quotation, the hirer must maintain insurance appropriate to the replacement value of the equipment and its activities, including public and employer's liability cover. Evidence of cover must be supplied on request. Insurance does not limit the hirer's contractual responsibilities.
11. Breakdown and replacement
The supplier will use reasonable efforts to diagnose a reported fault and, where practical, repair or replace equipment that fails through no act or omission of the hirer. Replacement availability and site access may affect timing. No unauthorised repair cost may be incurred on the supplier's behalf.
12. Return condition
Equipment must be switched off, safely decontaminated where relevant, packed with all accessories and returned by the agreed method and date. The supplier may inspect and test after return. Missing parts, avoidable contamination, damage beyond fair wear and unreported defects may be charged after assessment.
13. Cancellation and early termination
Cancellation rights, notice periods and any committed transport or preparation costs are stated in the quotation. The supplier may suspend or terminate the hire for non-payment, unsafe use, material breach, insolvency risk or failure to return equipment, subject to applicable law and any required notice.
14. Liability and excluded outcomes
Ozone equipment is supplied as one part of a controlled process. The supplier does not guarantee removal of a particular odour, contaminant or underlying cause unless an express written performance commitment is included in the quotation. Nothing in the contract excludes liability that cannot lawfully be excluded. Any other limits must be stated in the approved final terms and quotation.
15. Data, notices and governing law
Personal data is handled under the website privacy notice and for contract administration. Formal notices must use the contact details in the quotation. The governing law, courts, legal entity details, effective date and any liability cap will be inserted during business and legal approval before these terms are used for contracting.
